2. Service Description
diOptiScan is a pay-per-use digital computation service for industrial CT (computed tomography) scan optimization and fixture generation. Users can upload project data, configure scan parameters, and order automated computations. The service delivers digital results based on the submitted configurations.
3. Account Registration
Access to diOptiScan requires registration. You can register either via an invitation link or through the public registration form. If you register without an invitation, diondo GmbH will contact you to discuss the details of your use case and verify your account. Your account will be activated once this review process is complete. By registering, you agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activities that occur under your account.
4. Service Delivery
diOptiScan provides a digital service. By placing an order, you consent to the immediate commencement of the computation. Once the computation process has begun, the service is considered delivered. Results are made available within the platform for download by authorized users.
5. Pricing
Pricing is calculated on a per-project basis, depending on the selected configuration and scan parameters. The exact price is displayed before checkout so you can review the total cost before confirming your order. For details, see our Pricing page.
6. Payment
For orders paid through our online checkout, payment is processed by Paddle.com, which acts as the Merchant of Record. Paddle handles invoicing, payment processing, tax compliance, and refunds for those transactions. By purchasing through diOptiScan in this way, you also agree to Paddle's Terms of Use and Privacy Policy.
Where we offer prepaid account balance (credit), you may in individual cases top up that balance against an invoice issued by diondo GmbH; such payments are not processed by Paddle. Credit is applied to your account after we receive payment, as agreed in each case.
7. Refunds
For purchases processed through Paddle (our online checkout), you may request a refund within 14 days of your purchase. As a digital service, computation begins immediately upon order confirmation. For full details, please refer to our Refund Policy.
Prepaid account balance (credit) added by invoice or otherwise outside Paddle is not covered by this refund policy; any repayment of unused balance is only as expressly agreed with diondo GmbH.
8. Intellectual Property
You retain all rights to data you upload to diOptiScan. diondo GmbH retains all rights to the diOptiScan platform, its software, algorithms, and documentation. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
9. Data Handling
We process personal data in accordance with applicable data protection regulations. For detailed information about how we collect, use, and protect your data, please refer to our Privacy Policy.
10. Limitation of Liability
diondo GmbH is liable without limitation for damages caused by intent or gross negligence. For slight negligence, liability is limited to foreseeable, typical damages and only in cases of breach of material contractual obligations. Liability for damages arising from injury to life, body, or health remains unaffected. To the extent permitted by law, liability for indirect, incidental, or consequential damages is excluded.
11. Availability
We strive to ensure high availability of the diOptiScan platform but do not guarantee uninterrupted access. Planned maintenance and unforeseen technical issues may temporarily limit availability. We are not liable for any damages arising from temporary unavailability.
12. Changes to These Terms
We may update these Terms of Service from time to time. Changes will be communicated through the platform. Continued use of diOptiScan after changes have been published constitutes acceptance of the updated terms.
13. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Hattingen, Germany, to the extent permitted by law.
